Incumbent serves as IV-D Prosecutor for the Owen County Prosecutor's Office, responsible for supervising assigned staff, directing the activities of the IV-D division, and preparing for court proceedings.
DUTIES:
Supervises assigned staff, including planning, delegating, controlling work assignments and keeping supervisor and assigned staff informed of organization developments. Supervises law student interns as needed.
Organizes, manages, and directs activities of the IV-D division, including establishing child support obligations, ensuring collection, modifying existing policy, and managing paternity cases.
Represents the State of Indiana in all cases brought by the department, including adult criminal, juvenile, child support and paternity, expungements, dangerous persons petitions, probation and CCP revocations, and traffic.
Prosecutes traffic offenses, including felony, misdemeanor, and infraction cases.
Conducts legal research associated with prosecution of assigned cases, including reviewing related court decisions and legal precedents.
Reviews complaints filed, interviews involved parties, and gathers necessary information.
Prepares case for prosecution, including legal documents and filings, such as motions and petitions.
Prepares all files for court, including discovery responses.
Coordinates efforts in prosecutorial process with law enforcement, including providing information and advice to officers.
Prepares and communicates plea offers to defendants and their attorneys. Manages special projects at direction of Prosecutor.
Performs related duties as assigned.
I. JOB REQUIREMENTS:
Juris Doctor Degree in Law.
Ability to obtain and maintain State Law license and remain in good standing with State Supreme Court.
Thorough knowledge of and ability to apply federal, state, and local laws and ordinances to a variety of individual situations and circumstances for the preparation and prosecution of cases before the court.
Thorough knowledge of standard procedures and practices of Department and County courts, with ability to effectively prepare and argue cases before the court.
Practical knowledge of child support, temporary assistance for needy families, and other social services law and policy with ability to make practical applications and answer questions.
Working knowledge of standard office procedures with ability to apply such knowledge to a variety of interrelated processes, tasks, and operations.
Working knowledge of basic filing systems and ability to create and maintain accurate and complete Department files.
Working knowledge of standard English grammar, spelling, and punctuation and ability to prepare correspondence and detailed reports, interview to obtain information, and advise people.
Ability to supervise assigned staff, including planning, delegating, controlling work assignments and keeping supervisor and assigned staff informed of organization developments.
Ability to properly operate standard office equipment, including computers, calculators, and other equipment as needed.
Ability to comply with all employer and department policies and work rules, including, but not limited to, attendance, safety, drug-free workplace, and personal conduct.
Ability to provide public access to, or maintain confidentiality of, department information and records according to state requirements.
Ability to effectively communicate orally and in writing with co-workers, other County and State departments, courts, attorneys, victims, and the public, including being sensitive to professional ethics, gender, cultural diversities, and disabilities.
Ability to competently serve the public with diplomacy and respect, including occasional encounters with irate/hostile persons.
Ability to understand, memorize, retain, and carry out written or oral instructions and present findings in oral or written form.
Ability to work alone with minimum supervision and with others in a team environment.
Ability to work rapidly for long periods on several tasks at the same time, often under time pressure.
Ability to plan/layout assigned work projects and apply knowledge of people and locations.
Ability to speak publicly, including planning and presenting presentations, legal proceedings, or in court.
Ability to prepare detailed reports, such as arrest reports and financial statements. Ability to read/interpret detailed prints, sketches, layouts, specifications, and maps.
Ability to perform arithmetic tasks such as counting, adding, subtracting, computing, and calculating.
Ability to compare/observe similarities and differences between data, people, or things; perform arithmetic operations with data; and analyze, evaluate, observe, diagnose, and/or investigate data.
Ability to occasionally work extended hours, evenings, and weekends; travel out of town, sometimes overnight, for conferences, special assignments, and depositions; and respond to emergencies on a 24-hour rotation basis and from an off duty status.
II. DIFFICULTY OF WORK:
Incumbent performs a broad range of duties involving complex and complicated considerations and problems. Incumbent operates within very general guidelines and rules which require adaptation to address specific cases and circumstances.
III. RESPONSIBILITY:
Incumbent performs duties within general guidelines where desired results are indicated. Incumbent is responsible for addressing unusual problems and/or circumstances and may discuss these with supervisor. Incumbent's decisions have a substantial impact on departmental operations, and work product is periodically reviewed upon conclusion for soundness of judgment and conformity with departmental standards.
IV. PERSONAL WORK RELATIONSHIPS:
Incumbent maintains frequent contact with co-workers, other County and State departments, courts, attorneys, victims, and the public for the purpose of exchanging information, rendering service, and negotiating solutions.
Incumbent reports directly to Prosecutor.
V. PHYSICAL EFFORT AND WORK ENVIRONMENT:
Incumbent performs duties in a standard office environment and a courtroom, involving sitting/walking at will, sitting for long periods, lifting/carrying/pushing/pulling objects weighing under 25 pounds, close vision, hearing sounds/communication, and speaking clearly. Incumbent may be exposed to noisy environments, violent/irate individuals, and situations which may involve potential physical harm to self and others. Safety precautions must be followed at all times to avoid injury to self and others.
Incumbent occasionally works extended hours, evenings, and weekends; travels out of town, sometimes overnight, for conferences, special assignments, and depositions; and responds to emergencies on a 24-hour rotation basis and from an off duty status.
VI. OTHER:
The IV-D Deputy Prosecutor is an appointive position of the Prosecutor. Specific job duties and job requirements are established at the discretion of the Prosecutor. A person appointed to the IV-D Deputy Prosecutor position serves at the pleasure of the Prosecutor and may be terminated by the Prosecutor at any time.
